This website is operated by Souza Cruz LTDA. Please read these terms and conditions of use ("conditions of use") carefully. By accessing this website you agree to be bound by them. If you do not agree to be bound by these conditions of use you should not access or view this website.

To make these conditions of use easier to read, we use a few definitions. The terms ”Souza Cruz”, “we”, “us” and “our” are used to refer to Souza Cruz LTDA. 

The terms “British American Tobacco”, “the Group” and “The British American Tobacco Group” are used to refer to British American Tobacco p.l.c. and the group of companies constituting its direct and indirect subsidiaries worldwide, including Souza Cruz LTDA. 

These conditions of use contain six sections, including this introduction. Other sections below provide our privacy policy, our cookie policy, information about the external links that appear on this website, general provisions and company information.  These conditions of use are accessible from every page of this website.

Privacy Policy

This Privacy Policy (“Privacy Policy”) governs the processing of personal data that you (the “User”) share with SOUZA CRUZ LTDA. (hereinafter referred to as “SOUZA CRUZ”) when using the products, services, functionalities and/or digital tools (collectively, the “Services”) made available to Users by SOUZA CRUZ through its institutional Website http://www.souzacruz.com.br or any other website, application and/or digital platform owned by SOUZA CRUZ (collectively, the “Applications”).

While carrying out its activities, SOUZA CRUZ collects various pieces of information about people with whom it interacts as part of the operation of its business and may use them in the ways described in this Privacy Policy. We at SOUZA CRUZ reiterate our commitment to Users and our concern about the privacy and protection of your personal data. If you have any question doubt about this Privacy Policy, please contact us through the channels listed at the end of this instrument.

For the purposes of this document we clarify that the terms “British American Tobacco,” “the Group,” and “British American Tobacco Group” are used to refer to the British American Tobacco p.l.c. and the group of direct and indirect subsidiaries  thereof worldwide, including SOUZA CRUZ.

I. COLLECTION OF PERSONAL DATA

1.1. While performing its Services, SOUZA CRUZ requests and obtains personal data from its Users. Essentially, the personal data are sent by Users when registering with the Applications and/or when using the Services offered by SOUZA CRUZ.

1.2. Considering the purpose of the Services offered, personal data including the name, address, taxpayer identification number CPF, telephone number, individual identification number RG, and contact e-mail address may be required for the total operation of the Services. The User hereby consents to the collection and processing of such data for the purposes disclosed in this Privacy Policy.

1.3. If the User wishes to acquire additional products or services offered in the Applications, SOUZA CRUZ will collect additional data, which will be used only for making the payment for the Services agreed.

1.4. The personal data disclosed may be stored on servers located abroad - preferably in the United States in view of the cloud services we use - and will only be supplied to third parties in accordance with the Law and/or by court order. When using the Services, the user expressly consents to such international data transfer.

1.5. The data collected by SOUZA CRUZ are stored under the strictest data security practices in SOUZA CRUZ database (the “Database”). The Database is strictly monitored and protected, so that only qualified employees, who are contractually bound by the duties of secrecy and confidentiality, may access it. SOUZA CRUZ will use its best efforts to ensure that such information is always processed in accordance with the provisions of this Privacy Policy. However, SOUZA CRUZ cannot guarantee that the data protection and security will never be violated. In such circumstances, the User agrees that SOUZA CRUZ will not be held responsible for the unauthorized practice of acts of THIRD PARTIES PROMOTING the interception, deletion, alteration, modification or manipulation of the contents of the applications, or of personal data and other information and materials made available by the Users.

1.6. When using the Applications and accessing SOUZA CRUZ website, certain information about the User, including the Internet protocol (“IP address”), operating system, or the time spent in Applications will be stored by SOUZA CRUZ or by company hired for this purpose, which will be contractually bound to the duties of secrecy and confidentiality. These records can be used, for example, for the analysis of traffic and usage of the Applications.  If you do not consent to provide these data, you may configure your Internet browser to disable cookies, being aware that, in this case, disabling cookies may result in an inadequate operation of the functionalities of the Applications and  SOUZA CRUZ website.

1.7. SOUZA CRUZ does not process personal data of minors while performing its activities. If SOUZA CRUZ identifies data about a minor, these will be deleted immediately.

II. PERSONAL DATA PROCESSING

2.1. To perform the Services, SOUZA CRUZ will not share, lend or exchange Users' personal data with third parties for marketing or commercial purposes.

2.2. In the course of its activities, SOUZA CRUZ shares information with third parties, always with a view to improving its services and products offered, in the following cases: (i) BAT group companies; (ii) tax, auditing or other authorities if we believe we are legally required to do so and/or to help preventing fraud or protecting BAT’s rights, protecting the personal security of BAT employees or third parties; (iii) service providers, such as external consultants and professional consultants (including law firms, auditors and accountants), technical support functions and IT consultants who perform testing and development work on our commercial technology systems; (iv) third parties for background checks, credit rating checks, fulfillment of orders, delivery, customer support services and storage services; (v) outsourced IT providers including, but not limited to, e-mail/text messaging providers, cloud IT service providers, business suite solution providers, data analysis agencies, strategic IT implementation partners and hosting service providers; (vi) New business: In the event of an acquisition or merger of companies, establishment of business partnerships, joint ventures and other businesses, in which case this Privacy Policy will remain in force; and (vii) compliance with a legal obligation: SOUZA CRUZ can share information as needed to comply with all and any legal determination, whether judicial or extrajudicial, in which case SOUZA CRUZ will notify the User of which information will be shared. By accepting this Privacy Policy, the User expressly consents to such transactions, which may in some cases consist of international data transfer. In such cases, SOUZA CRUZ takes all necessary technical measures to ensure the security of personal data.

2.4. SOUZA CRUZ values the privacy of its Users and uses the personal data provided by them for the following purposes:

  • Implementing different products, services and/or digital tools contracted and made available to users by SOUZA CRUZ through the Applications. In order to fulfil this purpose, the personal data made available by Users may be shared with partners in the manner described in this Privacy Policy.
  • Contacting the User to confirm the information provided and request the sending of information still pending so that SOUZA CRUZ can properly perform its Services.
  • Outlining profiles and demographic trends of use of the website and/or Applications.
  • The data can also be used to manage and improve the functionalities of the Applications, customizing the services offered and compiling statistics and studies.
  • Meeting SOUZA CRUZ's legitimate interests, namely (i) risk analysis and management; (ii) prevention and detection of criminal activities; (iii) verification of credit rating; (iv) corporate restructuring; (v) activities related to information security and building security; (vi) management of customer, supplier and inter-company communication relationships; (vii) internal and external audits; and (viii) presenting and defending legal claims.

2.5. In the event of an order from a public authority requesting access to information stored by SOUZA CRUZ, the concerned Users and data subject will be notified so they may enforce the defense measures they deem appropriate.

2.6. In any case, the data collected through the Applications and because of the Services will be stored only for the period required under the applicable regulation or until it is necessary for the purposes for which it was collected. The data will then be deleted, in accordance with the law, except in the following cases: (i) compliance with a legal or regulatory obligation by SOUZA CRUZ; (ii) study by a research body, securing, whenever possible, the anonymization of personal data; (iii) transfer to a third party, provided that the data processing requirements established by law are observed; or (iv) use by SOUZA CRUZ exclusively, being prohibited the access by third parties, and as long as the data are anonymized.

III. THIRD-PARTY SYSTEMS AND APPLICATIONS

3.1. SOUZA CRUZ is not responsible for the processing of personal data by third parties as a result of the use of such third parties own systems, applications, websites and platforms generally. Any processing by third parties will be governed by such Third Party’s Privacy Policies.

3.2. Before using systems, applications, sites and platforms in general of any partner of SOUZA CRUZ the Users should carefully read the relevant Privacy Policy, being aware that SOUZA CRUZ is not responsible and cannot interfere with any processing of personal data by SOUZA CRUZ’ partners or third parties.

IV. TRUTHFULNESS AND UP-TO-DATENESS OF THE DATA

4.1. The Users warrant that the data provided is true and up-to-date, and undertake to update it whenever there are any changes to the same.

4.2. Users may access, correct or update their data at any time, and also request the final deletion thereof from SOUZA CRUZ servers, or otherwise enforce their rights provided in article 18 of Law no. 13.709/18 through the Service Channel shown in item VI of this Privacy Policy, being aware that if Users’ data is removed they will no longer be able to access the features and services provided.

V. INFORMATION SECURITY

5.1. SOUZA CRUZ has implemented appropriate technical and organizational security measures to (i) protect against unauthorized access to stored data and any backups thereof; and (ii) prevent unauthorized changes, disclosures and/or destruction of information held by SOUZA CRUZ.

5.2. We limit the access to information to those individuals who need it to provide the necessary support to Users, or ensure the best operation of our services, products and/or digital tools. These individuals are bound by the duty of confidentiality and subject to disciplinary sanction, including employment termination and prosecution in the event of failure to comply with their obligations.

5.3. If Users are suspicious of the misuse, loss or unauthorized access to their personal information, they must immediately contact SOUZA CRUZ through the service channel listed in item VI.
